    本研究の目的は、福島原発事故賠償制度を研究の基軸として、被災者の生活再建および被災地域の再生に迅速かつ適切に資する、人災ないし人為的要因が寄与する大規模災害全般に応用可能な賠償・補償制度の一つのあり方を示すことである。(1)原因者の法的責任を明らかにし（責任論）、(2)被害の実態を把握し、回復されるべき損害として法的に構成し（被害・損害論）、(3)被害回復にかかる賠償・補償方法のあるべき姿を検討する（救済論）過程において、大規模災害に関する国際的な研究動向や問題関心を反映させる研究体制をとっている。 今年度の大半は、新型コロナウイルスの感染防止のための各種施策に従い、国内外での現地調査等の人の移動や接触を伴う研究活動を控えざるを得なかった。一方、研究会については、オンライン開催にも慣れたことで、全体研究会だけでも４回開催することができた。第１回研究会（5月15日）は、いわき市民訴訟第一審判決の評釈、原発事故の避難指示区域外からの避難者・滞在者の被侵害権利・法益の検討を行った。第２回研究会（6月16日）は、原発事故訴訟における原状回復について複数の裁判例の評釈も含めた検討を行い、浪江原発訴訟の現状について弁護団の報告を受けた。第３回研究会（9月12日）は、原発事故賠償訴訟において東電が主張する弁済の抗弁について検討を行い、津島原発訴訟第一審判決の評釈を行った。第４回研究会（11月28日）は、愛媛訴訟控訴審判決の評釈を行い、原発事故からの復興における課題について検討した。こうした研究会などで研鑽を深めつつ、各自が研究論文を執筆して公表した。

    2019年度においては、高レベル放射性廃棄物と福島における放射性廃棄物について、それらの処理等に関する経済分析、意思決定のあり方、そして、それらの処理に当たる組織と機構について、研究班を組織し、文献調査や、関係する制度の比較研究などを実施し、また、2019年度における中間的総括に向けて、研究連携や複数回にわたる本研究プロジェクトに関わる日本国内の制度や課題等に関する研究会を開催してきた。 2019年度における研究代表者・研究分担者による研究成果としては、原子力損害の賠償（損害賠償訴訟やＡＤＲなど）や「ふるさと喪失」被害、除染土の再生利用に関する諸課題、エネルギー政策や原発のコスト評価、規制のあり方など、福島や日本における原子力政策・放射性廃棄物処理に関する多数の論文・共著書がある。また、5件の英語による研究報告・発表を含む計12件の学会報告等が行われた。これらにみられるように、着実に研究実績をあげている。 本研究は、国際比較研究であるから、国際研究会の場等において、台湾・韓国やドイツ等の研究者・実務家などとの意見交換のほか、本研究プロジェクトの最終年度となる2020年度における国際シンポジウムの開催に向けた研究打合せなどを行ってきた。 2019年度のおわりには、小規模ながらも、ドイツからＥＵ法とドイツ環境法の著名な研究者を招聘することができ、放射性廃棄物処理に関する法制度の現状や高レベル放射性廃棄物等の最終処分場立地選定をめぐる法制度と課題などについて研究報告を受けた。あわせて、日本の法制度や現状と課題に関する報告を行い、充実した質疑・議論と意見交換を行うことができた。この成果は、2020年度中に日本国内において公表する予定である。 なお、新型コロナウイルス感染蔓延とその対策を踏まえ、2020年3月後半に開催が予定されていた研究会等は中止となった。

    Tort law is facing new problematics since 1990's, especially in the cases of living environment violation, market transactions troubles including business-to-consumer site, and life and medical service errors. In order to make tort law theory more compatible with today's tort cases, our study worked to elucidate the structural characteristics of these new problems. The study was done not only from the legal interpretational view point but also from the institutional and legislative view point. It points out the structural characteristics of these new problems. First, the extension of liability cause form negligence to scientifically uncertain risk leads to a transformation of the concept of negligence. Second, the extension of the protection by tort law leads to diversification of legal benefit. Third, the pluralization of those involved in injury leads to the necessity to coordinate each one's duty and his liability.

    I have researched on the legal remedy systems for personal injuries and environmental damages caused by toxic exposure in Japan, the United States, and other jurisdictions. Then I studied on how to improve such legal remedy system, which includes how the relationship between each administrative compensation/remedy system and litigations should be, as well as on the suitable forms of collective litigation for mass torts, such as class action and group litigation.
