    2020年度は、医療・福祉サービスの需給調整、行政計画等の法的意義及び規範理論の構築に関する研究の深化を図った。コロナ禍の研究となり、そのことが病床逼迫に見られるように、期せずして、国民の健康を守るべき社会保障法における需給調整、計画等の重要性を顕在化させた。研究に当たっても、IT化の緊急時対応への応用など、最新の動向も反映させた。 具体的には、第1に、研究成果を著作に著すことである。人口減少が資源の地域偏在を加速化させることは、フランスも同様である。このためフランスで導入されているのが計画行政、企画公募等であり、これは医療・福祉のパラダイムシフトであった。日本における病床規制以外の社会福祉分野の総量規制、公募指定等は、フランスの改革に比肩しうる新たな政策手法である。また、運営基準等の遵守義務という伝統的な規制体系に加え、第三者評価等も組み込んだ許認可制度がフランスでは導入されており、そのことはサービス提供主体におけるPDCAサイクルの内在化の必要性を高める。つまり、あるべきサービス提供を描く計画のサービス提供への架橋の仕組みである。この点、フランス法はプロセスアプローチを制度内在化させている。加えて、地方医療庁の権能として、医療のみならず介護等の社会福祉分野も横断的に取り込んでいる。このことは、日本の地域包括ケアシステム構築にも通じる発想である。2020年は、このような研究成果を踏まえ、『＜概観＞社会福祉・医療運営論』（信山社、2020年）等を著した。 第2は、需給調整、計画等とコロナ禍の医療・福祉サービスの提供との関係である。フランスにおいて、地方医療庁の医療、介護等のサービス提供に関する司令塔としての権能が対策に反映されることになった。また、コロナ対応へのビッグデータの利用、遠隔医療等のIT化が進められた。これらの点は論文等に反映させ発表している。

    In the field of social welfare services based mainly on the individual-focused benefit sysytem after implementing the long-term care insurance , a contract signed between each service user and provider has become the fundamental framework of services. In order to ensure the right of users and to improve the quality of services , the tide of the times reqires a new approach to satisfy the optimum service standard instead of the minimum service standard. This comparative law research between Japan and France has pointed out the importance of the process approach such as internal and external evaluations of services and the integration of this approach into the traditional system of permits and licences.

    (1) The concept, values and legal systems of Advocacy were made clear especially in the field of long term care. (2) Advocacy services for the ageing by care managers were very poor from the viewpoint of their duties. (3) Codes of advocacy practice (concerning the informed choice, etc.) and adult at risk procedure were developed.

    (1) It was proved how elderlies' rights were infringed especially in the health care, community care and employment for elderlies. (2) It was inquired how elderlies' right to self-determination were implemented in the social administration for elderlies. (3) Advocacy services for the aging by attorneys, social workers and other agencies were investigated. (4) It was inspected how elderlies' rights were realized in the legislations which have concern with elderlies.
